La Sportiva Snc offers its customers the right of withdrawal. If the customer is not satisfied with the goods received, they may return them and receive a refund as required by current legislation (Legislative Decree No. 185/99 - Legislative Decree No. 206/2005), which establishes a deadline for exercising the right of withdrawal of 14 calendar days from receipt of the goods.
The customer is required to return the purchased products in perfect condition and in their original packaging and pay the return shipping costs (including the outward shipping costs if the goods are free of charge).
If the equipment has been installed, mounted, or assembled, the customer cannot exercise the unconditional right of withdrawal, as these operations alter the condition of the goods and their packaging, causing them to lose their "new and resalable" status. In this case, upon return of the product to the seller, an appraisal will be performed to estimate its true value.
Claiming this guarantee is simple:
Send a written and signed communication via certified email to lasportiva@pec.it or by registered mail with return receipt. The communication must include your personal information and the name of the purchased product.
Send the returned goods by parcel post or courier, placing them in their original packaging to ensure their integrity during transport (including any documentation and accessories: manuals, cables, etc.).
PLEASE NOTE THAT SHIPPING COSTS FOR RETURNING THE MERCHANDISE ARE THE RESPONSIBILITY OF THE PURCHASER EXERCISED BY THE RIGHT OF WITHDRAWAL.
La Sportiva snc will refund the amount paid within 14 days of receiving the goods, subject to verification of the complete integrity of the contents and the original packaging, along with the instruction manuals, as received. In the event of a refund, this will be made using the same payment method used for the purchase.
The Customer will receive the amount paid for the purchase of the goods, from which, if the package is collected by a courier appointed by us, the shipping cost will be deducted, which varies depending on the product. If the goods were sold with free or flat-rate shipping, the shipping cost will be recovered, and therefore both shipping and collection costs will be deducted from the refunded amount.
RIGHT OF WITHDRAWAL AND EXCEPTIONS FOR MADE-TO-ORDER OR REGISTERED GOODS
12.1 Pursuant to Article 59, letter c) of the Consumer Code (Legislative Decree 206/2005), the right of withdrawal is entirely excluded for the supply of goods made to order or clearly personalized.
The Customer acknowledges and accepts that this legal exclusion applies to:
Goods not in stock and marked as "factory-ordered specifically for you" (Art. 4.2), as manufacturing or procurement is initiated by the Seller exclusively upon specific order from the Customer. This includes goods marked "delivered in 5-7 working days."
Marine engines and goods subject to registration, as the issuance of official documentation (Power Declaration/Manufacturing Manual) uniquely associated with the Customer's tax code and product serial number renders the goods no longer resalable to third parties as "Factory New."
From the moment La Sportiva SNC forwards the production order to the factory, or initiates the administrative registration process in the Customer's name, the contract becomes final. The Customer loses the right to withdraw, refuse delivery, or request a refund of any sums paid.
If the Customer requests cancellation prior to delivery and La Sportiva SNC decides—at its sole and unquestionable discretion—to exceptionally accept the return of the ordered or registered item, the product will be depreciated and classified as "Used/Depreciated Goods." The following will be deducted from the refund:
A commercial depreciation penalty equal to 35% (22% VAT + 13% DEPRECIATION) of the value of the item.
The full cost of outbound and return shipping (calculated at the full courier rate for heavy/bulky goods).
The bank transaction handling costs (3%).
